General Conditions for Vehicle Rental at Moto Rent Mitjorn

1- Introduction

The following general conditions of vehicle rental regulate the contractual relationship between Moto Rent Mitjorn S.L. (hereinafter, the “lessor”) and the paying customer (hereinafter, the “lessee”), under which the lessor grants the lessee the use of a vehicle for a period, price, and other conditions stipulated in the contract. In case of discrepancies between the content of any point of the General Conditions and the specific conditions signed between the parties, the latter shall prevail. It is the lessee’s responsibility to always carry a copy of this contract during the use of the vehicle.


2- Customer Requirements

For all engine sizes, it is essential to have EXPERIENCE IN MOTORCYCLE DRIVING. In case the company’s staff perceives that the customer lacks the necessary skills to drive the motorcycle, the vehicle will not be handed over, and the payment made will not be refunded.

The customer must be over 18 years old and present a valid Passport or ID card, as well as the original and valid driver’s license. Photographs, reports, or any other document other than the original license will not be accepted. Failure to meet these requirements will result in the vehicle not being delivered, and the amount paid will not be refunded.

The lessee declares to possess the corresponding driver’s license for the rented vehicle.

If you come from a country not belonging to the European Union or the European Economic Area (Iceland, Liechtenstein, and Norway), we always advise you to obtain an INTERNATIONAL PERMIT in your country before coming.

3- Reservations, Modifications, and Cancellations

The reservation process must be made through our website, having completed at least the minimum payment to confirm the reservation.

The minimum rental period will be 1 day, counting the days in periods of 24 hours. To make modifications or cancellations to reservations, the customer must communicate through the same email used for the reservation or contact us at info@mitjornmotorent.com.

In case of modification or cancellation, the lessor is authorized to charge the rental amount for 1 day for each reserved vehicle. The lessee is offered the option of a supplement that allows modifying or canceling the reservation at no cost up to 24 hours before. After this period, the lessor is authorized to charge the rental amount for 1 day for each reserved vehicle.


4- Rental, Pickup, and Return of the Motorcycle

The customer will receive the vehicle in perfect working condition, including tires and accessories (keys, helmet, lock, and/or others). It must be verified together with the lessor upon receipt. The customer will be informed of the type of fuel required and will undertake to return the vehicle in the same condition as received. The customer has 1 hour after the hiring date to report any anomalies with the motorcycle. It undertakes to return the vehicle to Moto Rent Mitjorn S.L. on the date, time, and place agreed upon in the rental contract.

The rental contract will be made at the time indicated in the reservation, and the return time must be respected WITHOUT EXCEPTIONS. The rental contract will end when the lessee presents himself at the office with the vehicle and provided accessories.

The lessor reserves the right not to rent vehicles if deemed appropriate. Likewise, it reserves the right to withdraw the rented vehicle if the lessee uses it improperly or if the vehicle is driven under inferior physical conditions due to alcohol consumption, drugs, fatigue, or illness.

Under no circumstances will subleasing or driving the rented vehicle be allowed to persons other than the contracting customer, except with the express consent of the lessor.

For any extension of the contract, the lessee must communicate expressly in writing or appear at one of the Moto Rent Mitjorn offices before the end of the rental period established in the contract. The minimum extension period is 1 day (24 hours), and it can be extended according to the specific conditions of the contract and the rented vehicle. The use of the vehicle after the rental period or its extension is considered unauthorized use, and a complaint for misappropriation will be filed.

IT IS STRICTLY FORBIDDEN TO DRIVE THE RENTED VEHICLE OUTSIDE THE ISLAND OF FORMENTERA.


5- Contact, Assistance, Offices, and Hours

Our office and assistance hours are from 9:00 am to 1:00 pm and from 4:00 pm to 8:00 pm. After this time, the lessor is not responsible for the vehicle until 9:00 am the following day and may demand payment from the customer according to the tariff. However, in case of a breakdown in the vehicle preventing its proper return within the mentioned hours, the lessee acknowledges being informed of the permanent phone line for assistance during business hours to report incidents. Failure to communicate the breakdown to the lessor or the inability to return the vehicle does not exempt the lessee from responsibility.

6- Lessor’s Responsibility

Both the maintenance and lubrication of the vehicle are included in our rates. Repairs at a workshop or replacement of parts can only be carried out with the express written authorization of the lessor. Mechanical wear due to reasonable and normal use of the vehicle is assumed by Moto Rent Mitjorn.


7- Lessee’s Responsibility

The lessee undertakes to check the good condition of the vehicle upon receipt, as well as to inform himself of the type of fuel required. Likewise, any breakdowns resulting from misuse or incorrect fuel will be borne by the lessee. The lessee agrees to use and drive the vehicle in accordance with driving and traffic regulations and according to the specifications of the vehicle type. Assuming both civil and criminal liability for the use of the rented vehicle. The lessee is strictly prohibited from leaving Formentera Island with the rented vehicle from Moto Rent Mitjorn. The lessee agrees to maintain the vehicle, use the provided lock and/or vehicle blocking when parked in a safe and properly parked place when not in use, and not to keep the vehicle’s documents and/or other belongings inside it. The customer is prohibited from assigning, renting, mortgaging, pawning, selling, or in any way guaranteeing the vehicle. The lessee is responsible for all damages caused to the rented vehicle, including damages resulting from fire and theft, except for having contracted the franchise waiver for material damages. Vehicles have a deductible of up to €1.210,00. Accessories such as helmets, keys, trunk, locks, and/or elements not implicit in the vehicle are not covered by the deductible or its waiver. Also, in the event of theft of the vehicle, the deductible waiver will not be applicable, and the deductible will apply.


8- Incidents, Theft, and/or Accident

In case of an accident or theft, you must contact the Police within 24 hours of the incident. Likewise, you must make the pertinent theft report. You must notify Moto Rent Mitjorn by phone at +34 971322306 and then go to an office. In case of an accident with another vehicle, the customer must present to Moto Rent Mitjorn the completed accident report signed by both parties. In case of theft, you must present the theft report and the vehicle keys, and you must pay the full amount of the Franchise. If you do not file the report or do not present the keys of the stolen vehicle, you must pay the full amount of the Franchise plus a penalty of €302.50. In case of traffic violations, Moto Rent Mitjorn may charge €36,30 for administrative procedures and €60,50 for trips to a municipal deposit to retrieve the vehicle, which was removed due to the customer’s responsibility. These amounts will be charged directly to the customer’s credit card.


9- Coverage and Insurance

The lessee is insured for third-party civil liability through an insurance policy contracted by the lessor with an Insurance Company, and for personal injury to the extent and conditions established in the Mandatory Insurance regulation.


10- General Provisions

Moto Rent Mitjorn is not responsible for delays or blockages in the Internet network caused by deficiencies or overloads, as well as any other type of electronic system, nor for the inability to provide service or allow access for any reason. These General Conditions shall be governed by Spanish Law, which shall apply to their interpretation, validity, and enforcement. The parties expressly submit to the courts and tribunals of the place where the obligation is fulfilled to settle any disputes that may arise in the interpretation and/or enforcement of these General Conditions of Contracting. The signing of this, the driver(s), acknowledges having read and accepted the conditions detailed in this contract necessary for the driving of the vehicle.

Car rental conditions

DOCUMENTS THAT MUST BE BROUGHT WHEN COLLECTING THE VEHICLE:

  • Credit Card (NOT AMEX, NOT DINERS CLUB)
  • Driving Licence (valid)
  • Printed copy of the voucher or on a mobile device.

RENTAL CONDITIONS

The lessee receives the vehicle in perfect working condition, which is verified at the moment of taking possession; acknowledging having been informed of the type of fuel the vehicle requires and committing to return the vehicle in the same condition as received.

The lessee undertakes to pay all fines imposed for non-compliance with traffic rules and to notify the lessor at the time of settlement.

The lessee shall be held responsible both civilly and criminally for any liability that may arise from the use of the rented vehicle and, under no circumstances, may use it for the transport of goods, especially if such goods are of an illegal nature.

In reference to the provisions of the previous article, the lessee is insured against third-party civil liability through an insurance policy arranged by the lessor with an Insurance Company, and against bodily injury under the measures and conditions established in the Compulsory Insurance Regulations.

The lessee undertakes to carry the document issued by this company, to present it if required by the Authority or a representative of this Company.

The rental company reserves the right not to rent the vehicles if it deems it appropriate. Likewise, the rental company may withdraw the rented vehicle if the lessee misuses it, or if the vehicle is driven in a condition inferior due to alcohol, drugs, fatigue, or illness.

Under no circumstances shall the rented vehicle be sublet or driven by persons other than the contracting client, except with the express consent of the lessor.

  • MINIMUM AGE: 21 years and 2 years of experience for all groups, and 25 years and 3 years of experience for groups 2, 3, and 4.
  • YOUNG DRIVER: From 21 to 24 years old, due to accident risk, an extra charge of 3€ per day will be applied and they will not be eligible for the deductible waiver.
  • ADDITIONAL DRIVER (Optional): The rate to include an additional driver is 3€/day, up to a maximum of 35€.

INCLUDED: VAT, comprehensive insurance (CDW: Insurance that covers damage to the rented car) with a deductible of 600€ – 2500€ (depending on the car group), unlimited mileage, port charges, fees, and local taxes.

CHILD SEATS (OPTIONAL):

  • Group 0-3 seat, 4€/day.
  • Booster seat, 3€/day.
  • Maximum charge of 54€ per unit. Request in observations for the reservation of the required model.

DEDUCTIBLES AND INSURANCE: (Optional)

The basic insurance excludes loss, theft, or damage caused to goods or objects transported in the vehicle.

The DEDUCTIBLE and the waiver of the deductible payment (SUPER CDW: Insurance that covers damage to the rented car) in the event of an accident, loss, or misplacement of some of its parts, are detailed below:

* In group 4 models, the total deductible will be blocked or may be reduced by eliminating it, with a reduction and block amount of 1000€ + VAT.

If the client leaves the keys locked inside the car, a charge of 15€ will be applied for the transport of the duplicate keys. In the event of an accident, the company will replace the damaged vehicle if appropriate, provided that the rental conditions have not been breached.

 

OTHER CHARGES:

Payments resulting from improper use by the client: After the termination of the vehicle rental, the client undertakes to pay any amounts resulting from the following items:

1) Special cleaning charge for expenses incurred from an extra cleaning service due to the vehicle being returned in a manifestly unsuitable condition, with a maximum amount of 150€.

2) Charges arising from the loss of the vehicle’s documents and keys, and/or the sending of the set of keys to the corresponding office, in cases of loss, breakage, return of the vehicle keys to an office other than the one where the vehicle was actually returned, or any other situation in which the vehicle is immobilized due to reasons attributable to the client, for an amount of up to 250€.

2b) If the client leaves the keys locked inside the car, a charge of 15€ will be applied for the transport of the duplicate keys.

3) The cost of transporting the vehicle with a tow truck in the cases provided for in the various clauses of this Contract.

4) Expenses arising from the loss, deterioration, or damage to rims, tires (including punctures and blowouts), windows, mirrors, the interior of the vehicle, as well as problems resulting from an error in the type of fuel refilled.

5) Fines, penalties, and legal costs incurred due to traffic violations or breaches of laws, regulations, or ordinances, which have been paid by the client during the term of this Contract.

6) Without prejudice to the above, the company reserves the right to charge the client an additional 36,30€ for administrative costs incurred as a result of processing and communication expenses with the relevant authorities regarding such acts.

7) The costs of repairing damage caused to the vehicle in the event of an accident, when any of the following circumstances occur:

– That the vehicle was not used in accordance with the established conditions.

– Negligence in driving by not using the vehicle properly.

– Negligence in driving by not respecting the traffic laws established by the DGT.

 

EXTENSION OF THE RENTAL CONTRACT:

If you wish to extend the rental period indicated in the contract, the following steps must be followed:

Go to the nearest office at least 24 hours before the original end of the Rental Contract. The person in charge will verify that the vehicle is available for the new requested dates.

Conduct a vehicle inspection together with a company agent.

Pay the rental fee and the new additional charges.

Sign a new Rental Contract or an addendum to the original contract.

In the event that the above steps are not followed and the vehicle is not returned on the agreed date and time, the current rate for extra days plus a 50% penalty will be charged to the client.

The company reserves the right to deny the extension request for operational reasons.

Under no circumstances will extensions be granted by phone and/or email. It is absolutely essential to complete the above procedure at any of our offices.

 

FUEL POLICY:

The fuel policy to be followed at the time of vehicle delivery will always be transparent, always attempting first to follow a Full-to-Full policy. The company may opt for other fuel delivery and return policies, indicating any additional fuel charges at the rental counters. In the event that the lessee returns a greater amount of fuel, the company is not obliged to refund the difference

These costs are the responsibility of the lessee. If the client uses the wrong fuel when refueling, repair costs (*4) of 150€ + VAT will be charged to the lessee. The vehicle will be delivered ready to drive and with sufficient fuel to reach the nearest gas station.

 

ELECTRIC VEHICLES:

It is the responsibility of the lessee to always maintain the battery of the rented electric vehicle at an adequate and sufficient charge.

In the event of assistance due to a discharged battery, the client will bear all costs incurred (towing, operator transportation, etc.) and the vehicle will only be replaced if one is available. Such replacement (if possible) will be carried out at our offices, with an extra charge of 50€ for delivery outside of them.

If no vehicles are available for a replacement, the client will have to wait the necessary time for the battery to be fully recharged, with any travel to our offices being at their own risk.

Upon return of the vehicle, it must have a minimum of 30% battery. Otherwise, a charge for ONE FULL DAY OF RENTAL will be applied.

* ANNEX OF SPECIFIC RENTAL AND INSURANCE CONDITIONS FOR MANUAL CANVAS TOP AND ELECTRIC CANVAS TOP VEHICLES FOR GROUPS G, J, K, V, 2, 3, 4:

In cases where a vehicle included in Categories G, J, K, V, 2, 3, 4 is rented, the general rental and insurance conditions will apply in addition to the following specific conditions:

The client must inspect the canvas top and structure of the Jeep, Suzuki, or Mehari being rented, confirming its perfect state of preservation and functionality.

The client acknowledges and accepts that:

Any damage or loss incurred to the canvas top or its structure, whether accidental or intentional, is not covered by any type of insurance; therefore, the full cost of its repair or replacement (if it cannot be repaired) must be borne by the client.

Due to its design, any damage to the metal structure may require complete replacement because of the absence of individual parts. Damage to the canvas is irreparable, so the damaged and/or lost part(s) will be replaced.

The charge for damage or loss of the canvas top or its components may amount to 2.500€ according to the published “Damage and Loss Rates”.

The client will receive from the company the corresponding instructions for folding or unfolding the canvas top. In case of any doubt once the rental has begun, they should go to the nearest company office, where assistance will be provided.

 

VEHICLE DELIVERIES:

At the time of delivery and return, the company undertakes to perform an inspection of the vehicle’s condition if requested by the consumer, as well as to provide a copy of the vehicle delivery report, with its details, if the client so requests.

Info: Shuttle Service depending on the vehicle’s delivery and return dates, in order to expedite the client’s stay and ease congestion in the port area (This service may be activated by the rental company between the dates 01/05 and 31/09).

Night Reservations: (Optional Extra) Outside business hours, a surcharge of 35€ VAT included may apply from 21:00 to 23:59.

WARRANTY OF THE RESERVED VEHICLE

The company only guarantees the reserved model in vehicles indicated without the “or similar” option. If the vehicle you reserve is indicated as “SIMILAR”, you may be given the selected model, one within the same group and with similar features, or a vehicle belonging to a higher group. If, due to force majeure, the reserved group or model cannot be provided, alternatives from a higher category group will be offered at no additional cost to the client.

PAYMENT METHOD: VISA, MASTERCARD, CASH.

Debit cards are NOT accepted for the deposit (a CREDIT CARD must be presented when collecting the vehicle). Payment for the online reservation amount will ALWAYS be made upon arrival using a CREDIT CARD. NOT AMEX, NOT DINERS CLUB
